{"id":10963,"date":"2021-12-31T14:24:29","date_gmt":"2021-12-31T17:24:29","guid":{"rendered":"https:\/\/magalhaesdealmeida.ma.gov.br\/transparencia\/?post_type=publicacoesdom&#038;p=10963"},"modified":"2021-12-31T14:24:29","modified_gmt":"2021-12-31T17:24:29","slug":"lei-n-o-534-2021-2","status":"publish","type":"publicacoesdom","link":"https:\/\/magalhaesdealmeida.ma.gov.br\/transparencia\/publicacoesdom\/lei-n-o-534-2021-2\/","title":{"rendered":"LEI N.\u00ba 534\/2021"},"content":{"rendered":"<p><strong>DISP\u00d5E SOBRE A REESTRUTURA ADMINISTRATIVA, ORGANIZACIONAL E INSTITUCIONAL DA PREFEITURA MUNICIPAL DE MAGALH\u00c3ES DE ALMEIDA E D\u00c1 OUTRAS PROVID\u00caNCIAS.<br \/>\n<\/strong>O PREFEITO MUNICIPAL DE MAGALH\u00c3ES DE ALMEIDA, ESTADO DO MARANH\u00c3O, no uso de suas atribui\u00e7\u00f5es que lhe s\u00e3o conferidas por Lei, <strong>FA\u00c7O SABER<\/strong> que a C\u00e2mara Municipal de Vereadores aprovou e eu <strong>SANCIONO<\/strong> a seguinte Lei:<br \/>\n<strong>T\u00cdTULO I &#8211; <\/strong><strong>DISPOSI\u00c7\u00d5ES PRELIMINARES:<br \/>\n<\/strong><strong>Art. 1\u00ba &#8211;<\/strong>A estrutura administrativa, organizacional e institucional da Prefeitura Municipal de Magalh\u00e3es de Almeida &#8211; MA passa a reger-se por esta Lei que promove sua reorganiza\u00e7\u00e3o e reestrutura\u00e7\u00e3o, que est\u00e1 baseada:<br \/>\n<strong>I \u2013<\/strong> na responsabilidade fiscal, atrav\u00e9s do planejamento p\u00fablico e do equil\u00edbrio financeiro, buscando atingir maior economicidade na realiza\u00e7\u00e3o das despesas;<br \/>\n<strong>II \u2013<\/strong> na moderniza\u00e7\u00e3o e inova\u00e7\u00e3o da gest\u00e3o p\u00fablica municipal, de forma a evitar a fragmenta\u00e7\u00e3o das a\u00e7\u00f5es e a promover a harmonia dos servi\u00e7os p\u00fablicos essenciais disponibilizados ao cidad\u00e3o, com maior efici\u00eancia e efic\u00e1cia;<br \/>\n<strong>III \u2013<\/strong> na autoridade e responsabilidade, com o comprometimento dos agentes p\u00fablicos na execu\u00e7\u00e3o de atos de gest\u00e3o e de governo;<br \/>\n<strong>IV \u2013<\/strong> na transpar\u00eancia administrativa, permitindo a participa\u00e7\u00e3o ativa da sociedade na defini\u00e7\u00e3o das prioridades e na execu\u00e7\u00e3o dos programas municipais, atrav\u00e9s dos \u00f3rg\u00e3os colegiados.<br \/>\n<strong>T\u00cdTULO II &#8211; <\/strong><strong>DA ADMINISTRA\u00c7\u00c3O MUNICIPAL CAP\u00cdTULO I &#8211; <\/strong><strong>DA COMPOSI\u00c7\u00c3O:<br \/>\n<\/strong><strong>Art. 2\u00ba<\/strong>. A Administra\u00e7\u00e3o Municipal compreende:<br \/>\n<strong>I \u2013<\/strong> a Administra\u00e7\u00e3o Direta, constitu\u00edda dos seguintes \u00f3rg\u00e3os integrados na sua estrutura administrativa:<br \/>\n<strong>a)<\/strong>\u00f3rg\u00e3os de dire\u00e7\u00e3o geral e assessoramento superior, desdobrados em \u00f3rg\u00e3os de coordena\u00e7\u00e3o e execu\u00e7\u00e3o, de assessoramento intermedi\u00e1rio e de dire\u00e7\u00e3o setorial de suas respectivas estruturas sistematizadas;<br \/>\n<strong>b)<\/strong> \u00f3rg\u00e3os de dire\u00e7\u00e3o departamental e divisional de administra\u00e7\u00e3o desconcentrada;<br \/>\n<strong>c)<\/strong> \u00f3rg\u00e3os<br \/>\n<strong>II \u2013<\/strong> a Administra\u00e7\u00e3o Indireta, que compreende os servi\u00e7os p\u00fablicos ou de interesse p\u00fablico, atribu\u00eddos a pessoas jur\u00eddicas diversas do Munic\u00edpio, dotadas de personalidade jur\u00eddica pr\u00f3pria, com autonomia administrativa e financeira que vierem a ser criados por lei espec\u00edfica.<br \/>\n<strong>III-<\/strong> \u00f3rg\u00e3os Colegiados.<br \/>\n<strong>Art. 3\u00ba<\/strong>. As entidades da Administra\u00e7\u00e3o Indireta que vierem a ser criadas por lei espec\u00edfica, ser\u00e3o vinculadas ao Gabinete do Chefe do Poder Executivo cuja \u00e1rea de compet\u00eancia enquadra-se na sua atividade institucional, sujeitando\u2013se \u00e0 correspondente tutela administrativa.<br \/>\n<strong>CAP\u00cdTULO II &#8211; DO SISTEMA MUNICIPAL DE CONTROLE INTERNO:<br \/>\n<\/strong><strong>Art. 4\u00ba<\/strong>. O Sistema Municipal de Controle Interno tem como finalidade exercer a atividade de auditoria interna nos \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o P\u00fablica Direta e Indireta do Poder Executivo do Munic\u00edpio de Magalh\u00e3es de Almeida, nos termos do art. 31 da Constitui\u00e7\u00e3o Federal, e do art. 59 da Lei de Responsabilidade Fiscal.<br \/>\n<strong>CAP\u00cdTULO III &#8211; <\/strong><strong>DA ORGANIZA\u00c7\u00c3O DO PODER EXECUTIVO:<br \/>\n<\/strong><strong>Art. 5\u00ba. <\/strong>O Poder Executivo \u00e9 exercido pelo Prefeito do Munic\u00edpio, pelo Procurador Geral do Munic\u00edpio, pelo Chefe de Gabinete do Prefeito e pelos Secret\u00e1rios Municipais, para cumprimento de suas atribui\u00e7\u00f5es e compet\u00eancias constitucionais, legais e regulamentares.<br \/>\n<strong>\u00a71\u00ba<\/strong>. Os cargos de Chefe de Gabinete do Prefeito, Procurador Geral, Controlador, Ouvidor, Secret\u00e1rios Municipais e Presidente de \u00f3rg\u00e3os da Administra\u00e7\u00e3o P\u00fablica Indireta que vierem a ser criados por lei espec\u00edfica, possuem o mesmo n\u00edvel hier\u00e1rquico e funcional, iguais direitos, deveres e responsabilidades administrativas, respeitadas as atribui\u00e7\u00f5es inerentes \u00e0s compet\u00eancias legais de cada \u00f3rg\u00e3o ou entidade.<br \/>\n<strong>\u00a72\u00ba<\/strong>. Os titulares dos \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o Municipal s\u00e3o respons\u00e1veis, perante o Prefeito do Munic\u00edpio, pelo adequado funcionamento, bem como pela efic\u00e1cia e efici\u00eancia das estruturas sob sua dire\u00e7\u00e3o ou compreendidas em sua \u00e1rea de compet\u00eancia.<br \/>\n<strong>\u00a73\u00ba<\/strong>. A supervis\u00e3o ser\u00e1 exercida atrav\u00e9s da orienta\u00e7\u00e3o, coordena\u00e7\u00e3o e controle das atividades dos \u00f3rg\u00e3os subordinados ou vinculados \u00e0 Secretaria, nos termos desta Lei.<br \/>\n<strong>CAP\u00cdTULO IV &#8211; <\/strong><strong>DOS PRINC\u00cdPIOS CONSTITUCIONAIS E FUNDAMENTAIS:<br \/>\n<\/strong><strong>Art. 6\u00ba. <\/strong>Os \u00f3rg\u00e3os e entidades da Administra\u00e7\u00e3o P\u00fablica Municipal obedecer\u00e3o aos princ\u00edpios de legalidade, impessoalidade, moralidade, publicidade e efici\u00eancia, nos termos do art. 37 da Constitui\u00e7\u00e3o Federal, e consoante \u00e0s disposi\u00e7\u00f5es da Lei Org\u00e2nica Municipal, bem como aos seguintes princ\u00edpios fundamentais:<br \/>\n<strong>I\u2013<\/strong> planejamento;<br \/>\n<strong>II\u2013<\/strong> coordena\u00e7\u00e3o;<br \/>\n<strong>III\u2013<\/strong> descentraliza\u00e7\u00e3o;<br \/>\n<strong>IV\u2013<\/strong> delega\u00e7\u00e3o de compet\u00eancia;<br \/>\n<strong>V\u2013<\/strong> controle.<br \/>\n<strong>Se\u00e7\u00e3o I &#8211; <\/strong><strong>Do Planejamento:<br \/>\n<\/strong><strong>Art. 7\u00ba. <\/strong>O Poder Executivo Municipal adotar\u00e1 permanente processo de planejamento governamental que vise promover o desenvolvimento f\u00edsico\u2013territorial, econ\u00f4mico, social e de prote\u00e7\u00e3o ambiental do Munic\u00edpio, bem como a capta\u00e7\u00e3o e aplica\u00e7\u00e3o dos recursos humanos, materiais e financeiros, estabelecidos nos seguintes instrumentos b\u00e1sicos:<br \/>\n<strong>I\u2013<\/strong> Plano Plurianual;<br \/>\n<strong>II\u2013<\/strong> Plano Diretor;<br \/>\n<strong>III\u2013<\/strong> Diretrizes Or\u00e7ament\u00e1rias;<br \/>\n<strong>IV\u2013<\/strong> Or\u00e7amentos Anuais.<br \/>\n<strong>Se\u00e7\u00e3o II &#8211; <\/strong><strong>Da Coordena\u00e7\u00e3o:<br \/>\n<\/strong><strong>Art. 8\u00ba. <\/strong>As atividades da Administra\u00e7\u00e3o Municipal e, especialmente a execu\u00e7\u00e3o dos planos e programas de Governo, ser\u00e3o objeto de permanente coordena\u00e7\u00e3o.<br \/>\n<strong>\u00a71\u00ba. <\/strong>A coordena\u00e7\u00e3o ser\u00e1 exercida em todos os n\u00edveis da Administra\u00e7\u00e3o, mediante a atua\u00e7\u00e3o das chefias individuais e a realiza\u00e7\u00e3o sistem\u00e1tica de reuni\u00f5es, com a participa\u00e7\u00e3o das chefias subordinadas.<br \/>\n<strong>\u00a72\u00ba<\/strong>. Quando submetidos ao Prefeito, os assuntos dever\u00e3o ter sido previamente coordenados com todos os setores neles interessados, inclusive no que se refere aos aspectos administrativos pertinentes, atrav\u00e9s de consultas e entendimentos, de modo \u00e0 sempre compreenderem solu\u00e7\u00f5es integradas e que se harmonizem com a pol\u00edtica geral e setorial do Governo.<br \/>\n<strong>Se\u00e7\u00e3o III &#8211; <\/strong><strong>Da Descentraliza\u00e7\u00e3o:<br \/>\n<\/strong><strong>Art. 9\u00ba. <\/strong>A execu\u00e7\u00e3o das atividades da Administra\u00e7\u00e3o Municipal dever\u00e1 ser convenientemente descentralizada.<br \/>\n<strong>\u00a71\u00ba. <\/strong>A descentraliza\u00e7\u00e3o ocorrer\u00e1 mediante os seguintes planos principais:<br \/>\n<strong>a)<\/strong>dentro dos quadros da Administra\u00e7\u00e3o Municipal, distinguindo\u2013se o n\u00edvel de dire\u00e7\u00e3o de execu\u00e7\u00e3o;<br \/>\n<strong>b)<\/strong>da Administra\u00e7\u00e3o Municipal com o Estado e a Uni\u00e3o, mediante conv\u00eanio;<br \/>\n<strong>c)<\/strong>da Administra\u00e7\u00e3o Municipal para o setor privado, mediante contratos, conv\u00eanios ou concess\u00f5es.<br \/>\n<strong>\u00a72\u00ba<\/strong>. Compete ao Chefe do Poder Executivo o estabelecimento das normas, crit\u00e9rios, programas e princ\u00edpios, que os servidores respons\u00e1veis pela execu\u00e7\u00e3o s\u00e3o obrigados a respeitar na solu\u00e7\u00e3o dos casos individuais e no desempenho de suas atribui\u00e7\u00f5es.<br \/>\n<strong>Se\u00e7\u00e3o IV &#8211; <\/strong><strong>Da Delega\u00e7\u00e3o de Compet\u00eancia:<br \/>\n<\/strong><strong>Art. 10. <\/strong>A delega\u00e7\u00e3o de compet\u00eancia ser\u00e1 utilizada como instrumento de descentraliza\u00e7\u00e3o administrativa de tarefas cometidas diretamente ao Prefeito, com objetivo de assegurar maior rapidez e objetividade \u00e0s decis\u00f5es.<br \/>\n<strong>Art. 11. <\/strong>\u00c9 facultado ao Prefeito delegar compet\u00eancia para a pr\u00e1tica de atos administrativos, nos limites dispostos na Lei Org\u00e2nica Municipal.<br \/>\n<strong>Par\u00e1grafo \u00danico.<\/strong> O ato de delega\u00e7\u00e3o indicar\u00e1, com precis\u00e3o, a autoridade e as atribui\u00e7\u00f5es pertinentes ao objeto da delega\u00e7\u00e3o.<br \/>\n<strong>Se\u00e7\u00e3o V &#8211; <\/strong><strong>Do Controle:<br \/>\n<\/strong><strong>Art. 12. <\/strong>O controle das atividades da Administra\u00e7\u00e3o Municipal ser\u00e1 exercido em todos os n\u00edveis e em todos os \u00f3rg\u00e3os, compreendendo particularmente:<br \/>\n<strong>I \u2013<\/strong> o controle pela chefia competente, da execu\u00e7\u00e3o dos programas e da observ\u00e2ncia das normas que regulam as atividades espec\u00edficas pertinentes a cada unidade administrativa;<br \/>\n<strong>II \u2013<\/strong> o controle, pelos \u00f3rg\u00e3os competentes, da observ\u00e2ncia das normas gerais que regulam o exerc\u00edcio das atividades auxiliares;<br \/>\n<strong>III \u2013<\/strong> o controle da aplica\u00e7\u00e3o do dinheiro p\u00fablico e da guarda dos bens do Munic\u00edpio pelos \u00f3rg\u00e3os competentes para aquela atividade.<br \/>\n<strong>CAP\u00cdTULO V &#8211; <\/strong><strong>DAS NORMAS RELATIVAS A LICITA\u00c7\u00d5ES PARA COMPRAS, OBRAS, SERVI\u00c7OS E ALIENA\u00c7\u00d5ES:<br \/>\n<\/strong><strong>Art. 13. <\/strong>As licita\u00e7\u00f5es para compras, obras, servi\u00e7os e aliena\u00e7\u00f5es, regulam\u2013se pelas normas previstas na Lei Federal n\u00b0 8.666 de 21 de junho de 1993, Lei Federal n\u00ba 14.133\/21 e legisla\u00e7\u00e3o posterior, e obedecer\u00e3o ao rito processual prescrito nos atos normativos e ordinat\u00f3rios editados no \u00e2mbito da Administra\u00e7\u00e3o Municipal.<br \/>\n<strong>T\u00cdTULO III &#8211; <\/strong><strong>DO SISTEMA ADMINISTRATIVO<br \/>\n<\/strong><strong>CAP\u00cdTULO I &#8211; <\/strong><strong>DOS \u00d3RG\u00c3OS E SUAS FINALIDADES:<br \/>\n<\/strong><strong>Art. 14. <\/strong>S\u00e3o \u00f3rg\u00e3os de dire\u00e7\u00e3o geral, considerados de primeiro n\u00edvel hier\u00e1rquico da estrutura administrativa, o Gabinete do Prefeito, as Secretarias Municipais, a Procuradoria Geral do Munic\u00edpio e a Controladoria Geral do Munic\u00edpio, competindo\u2013lhes o assessoramento superior e o desempenho de fun\u00e7\u00f5es sist\u00eamicas e finalistas.<br \/>\n<strong>Par\u00e1grafo \u00fanico <\/strong>&#8211; As Assessorias T\u00e9cnicas, bem como as Coordenadorias e Departamentos s\u00e3o \u00f3rg\u00e3os destinados \u00e0 coordena\u00e7\u00e3o e execu\u00e7\u00e3o das a\u00e7\u00f5es de governo, com subordina\u00e7\u00e3o hier\u00e1rquica, administrativa e funcional \u00e0s Secretarias Municipais, dentro das respectivas \u00e1reas de atua\u00e7\u00e3o.<br \/>\n<strong>Art. 15. <\/strong>S\u00e3o \u00f3rg\u00e3os colegiados os Conselhos Municipais, institu\u00eddos como organismos de coopera\u00e7\u00e3o com o Poder Executivo, com a finalidade de assessorar a Administra\u00e7\u00e3o no planejamento, an\u00e1lise e tomada de decis\u00f5es em mat\u00e9ria de sua compet\u00eancia, vinculados \u00e0s Secretarias Municipais em raz\u00e3o das respectivas atribui\u00e7\u00f5es institucionais, nos termos da Lei Org\u00e2nica Municipal.<br \/>\n<strong>CAPITULO II &#8211; <\/strong><strong>DA ESTRUTURA ORGANIZACIONAL:<br \/>\n<\/strong><strong>Art. 16. <\/strong>A estrutura organizacional b\u00e1sica do Poder Executivo do Munic\u00edpio de Magalh\u00e3es de Almeida comp\u00f5e\u2013se dos seguintes \u00d3rg\u00e3os e Entidades:<br \/>\n<strong>I &#8211;<\/strong> Administra\u00e7\u00e3o e Assessoramento Superior:<br \/>\n<strong>a)<\/strong> Gabinete do Prefeito;<br \/>\n<strong>b)<\/strong> Procuradoria Geral do Munic\u00edpio;<br \/>\n<strong>c)<\/strong> Controladoria Geral do Munic\u00edpio;<br \/>\n<strong>d)<\/strong> Ouvidoria do Munic\u00edpio;<br \/>\n<strong>II &#8211;<\/strong> \u00d3rg\u00e3os de Administra\u00e7\u00e3o Instrumental e Execu\u00e7\u00e3o Program\u00e1tica:<br \/>\n<strong>a)<\/strong> Secretaria Municipal de Administra\u00e7\u00e3o;<br \/>\n<strong>b)<\/strong> Secretaria Municipal de Finan\u00e7as;<br \/>\n<strong>c)<\/strong> Secretaria Municipal de Educa\u00e7\u00e3o, Ci\u00eancias, Tecnologia e Inova\u00e7\u00e3o;<br \/>\n<strong>d)<\/strong> Secretaria Municipal de Sa\u00fade;<br \/>\n<strong>e)<\/strong> Secretaria Municipal de Cultura, Turismo e Comunica\u00e7\u00e3o;<br \/>\n<strong>f)<\/strong> Secretaria Municipal de Infraestrutura, Servi\u00e7os Urbanos e Paisagismo;<br \/>\n<strong>g)<\/strong> Secretaria Municipal de Assist\u00eancia Social;<br \/>\n<strong>h)<\/strong> Secretaria Municipal de Esporte e Juventude;<br \/>\n<strong>i)<\/strong> Secretaria Municipal de Agricultura, Pesca, Pecu\u00e1ria e Meio Ambiente;<br \/>\n<strong>j)<\/strong>Secretaria Municipal de Cidadania e Direitos Humanos;<br \/>\n<strong>III \u2013<\/strong> \u00d3rg\u00e3os Colegiados:<br \/>\n<strong>a)<\/strong> Conselho Municipal de Acompanhamento e Controle Social do FUNDEB;<br \/>\n<strong>b)<\/strong> Conselho Municipal de Alimenta\u00e7\u00e3o Escolar;<br \/>\n<strong>c)<\/strong> Conselho Municipal de Assist\u00eancia Social;<br \/>\n<strong>d)<\/strong> Conselho Municipal de Cultura;<br \/>\n<strong>e)<\/strong> Conselho Municipal de Seguran\u00e7a Alimentar e Nutricional;<br \/>\n<strong>f)<\/strong> Conselho Municipal de Desenvolvimento Rural;<br \/>\n<strong>g)<\/strong> Conselho Municipal de Educa\u00e7\u00e3o;<br \/>\n<strong>h)<\/strong> Conselho Municipal de Sa\u00fade;<br \/>\n<strong>i) <\/strong>Conselho Municipal dos Direitos da Crian\u00e7a e do Adolescente;<br \/>\n<strong>j)<\/strong> Conselho<br \/>\n<strong>IV &#8211;<\/strong> \u00d3rg\u00e3os Sist\u00eamicos Especiais:<br \/>\n<strong>a)<\/strong> Fundo Municipal de Sa\u00fade;<br \/>\n<strong>b)<\/strong> Fundo Municipal de Assist\u00eancia Social;<br \/>\n<strong>c)<\/strong> Fundo de Manuten\u00e7\u00e3o e Desenvolvimento da Educa\u00e7\u00e3o B\u00e1sica e de Valoriza\u00e7\u00e3o dos Profissionais da Educa\u00e7\u00e3o;<br \/>\n<strong>d)<\/strong> Fundo Municipal de Agricultura;<br \/>\n<strong>e)<\/strong> Fundo Municipal de Meio Ambiente;<br \/>\n<strong>\u00a71\u00ba <\/strong>&#8211; As Assessorias Gerais ter\u00e3o vincula\u00e7\u00e3o administrativa, financeira e or\u00e7ament\u00e1ria vinculada \u00e0s Secretaria Municipais as quais pertencerem.<br \/>\n<strong>\u00a72\u00ba <\/strong>&#8211; O Organograma da Estrutura Administrativa da Prefeitura Municipal de Magalh\u00e3es de Almeida consta no Anexo II e \u00e9 parte integrante desta Lei.<br \/>\n<strong>\u00a73\u00ba <\/strong>&#8211; No desenvolvimento das unidades administrativas e respectivos cargos de provimento em comiss\u00e3o, o Poder Executivo ter\u00e1 como limite o quantitativo e a classifica\u00e7\u00e3o de cargos comissionados fixados no Anexo I, que tamb\u00e9m \u00e9 parte integrante desta Lei.<br \/>\n<strong>T\u00cdTULO IV &#8211; <\/strong><strong>DA COMPET\u00caNCIA E COMPOSI\u00c7\u00c3O DOS ORG\u00c3OS<br \/>\n<\/strong><strong>CAP\u00cdTULO I &#8211; <\/strong><strong>DO GABINETE DO PREFEITO<br \/>\n<\/strong><strong>Art. 17. <\/strong>O Gabinete do Prefeito, representado pela sigla \u201cGAB\u201d, \u00e9 o \u00f3rg\u00e3o de assist\u00eancia ao Prefeito Municipal, para fun\u00e7\u00f5es pol\u00edticas, rela\u00e7\u00f5es p\u00fablicas, atendimento aos Mun\u00edcipes e pessoal externo ao \u00e2mbito municipal de liga\u00e7\u00e3o com o Poder Legislativo Municipal. A Controladoria Geral do Munic\u00edpio, representada pela sigla \u201cCGM\u201d, \u00e9 o \u00f3rg\u00e3o dotado de autonomia funcional, subordinada diretamente ao Chefe do Poder Executivo, que tem como finalidade principal a avalia\u00e7\u00e3o governamental e da gest\u00e3o dos administradores p\u00fablicos municipais, por interm\u00e9dio da fiscaliza\u00e7\u00e3o cont\u00e1bil, financeira, or\u00e7ament\u00e1ria, operacional e patrimonial, e apoiar o controle externo no exerc\u00edcio de sua miss\u00e3o institucional.<br \/>\n<strong>Art. 23<\/strong>. A Controladoria Geral do Munic\u00edpio tem as seguintes finalidades:<br \/>\n<strong>I \u2013<\/strong> Avaliar o cumprimento das metas previstas no Plano Plurianual, na Lei de Diretrizes Or\u00e7ament\u00e1rias e na Lei Or\u00e7ament\u00e1ria Anual, bem como a execu\u00e7\u00e3o dos programas de governo e dos or\u00e7amentos do munic\u00edpio;<br \/>\n<strong>II \u2013<\/strong> Comprovar a legalidade e avaliar os resultados, quanto a efic\u00e1cia e efici\u00eancia, da gest\u00e3o or\u00e7ament\u00e1ria, financeira e patrimonial nos \u00f3rg\u00e3os e nas entidades da administra\u00e7\u00e3o publica municipal, bem como da aplica\u00e7\u00e3o de recursos p\u00fablicos por entidades de direito privado;<br \/>\n<strong>III\u2013<\/strong> Exercer o controle das opera\u00e7\u00f5es de cr\u00e9ditos, avais e garantias, bem como, direitos e haveres do munic\u00edpio;<br \/>\n<strong>IV \u2013<\/strong> Apoiar o controle externo no exerc\u00edcio de sua miss\u00e3o institucional;<br \/>\n<strong>Art. 24<\/strong>. Sem preju\u00edzo de outras a\u00e7\u00f5es que se fa\u00e7am necess\u00e1rias compete ainda \u00e0 SEMAPA:<br \/>\n<strong>I &#8211;<\/strong> formular e implementar pol\u00edticas e diretrizes de desenvolvimento ambiental para o munic\u00edpio, observadas as peculiaridades locais;<br \/>\n<strong>II &#8211;<\/strong> formular e implementar as normas t\u00e9cnicas e legais e os padr\u00f5es de prote\u00e7\u00e3o, conserva\u00e7\u00e3o, preserva\u00e7\u00e3o e recupera\u00e7\u00e3o do meio ambiente, observadas as legisla\u00e7\u00f5es federal e estadual;<br \/>\n<strong>III &#8211;<\/strong> exercer a a\u00e7\u00e3o fiscalizadora de observ\u00e2ncia das normas contidas na legisla\u00e7\u00e3o ambiental;<br \/>\n<strong>IV &#8211;<\/strong> exercer o poder de pol\u00edcia nos casos de infra\u00e7\u00e3o da lei ambiental e de inobserv\u00e2ncia de norma ou padr\u00e3o estabelecido;<br \/>\n<strong>V &#8211;<\/strong> emitir parecer sobre os pedidos de localiza\u00e7\u00e3o e funcionamento de fontes poluidoras e de fontes degradadoras dos recursos ambientais;<br \/>\n<strong>VI &#8211;<\/strong> expedir Alvar\u00e1s de Localiza\u00e7\u00e3o e Funcionamento ou quaisquer outras licen\u00e7as relacionadas \u00e0s atividades de Controle Ambiental;<br \/>\n<strong>VII &#8211;<\/strong> formular as normas t\u00e9cnicas e legais que constituam as posturas do munic\u00edpio no que se refere ao saneamento e aos servi\u00e7os urbanos e rurais;<br \/>\n<strong>VIII &#8211;<\/strong> planejar, coordenar, executar e atualizar o cadastramento de atividades econ\u00f4micas degradadoras do meio ambiente e de informa\u00e7\u00f5es ambientais do munic\u00edpio;<br \/>\n<strong>IX &#8211;<\/strong> estabelecer as \u00e1reas ambientais priorit\u00e1rias em que o Executivo Municipal deve atuar para manter a qualidade do meio ambiente local;<br \/>\n<strong>X &#8211;<\/strong> propor a cria\u00e7\u00e3o, no munic\u00edpio, de \u00e1reas de interesse para prote\u00e7\u00e3o ambiental;<br \/>\n<strong>XI &#8211;<\/strong> desenvolver atividades de educa\u00e7\u00e3o ambiental e atuar na forma\u00e7\u00e3o da consci\u00eancia p\u00fablica sobre a necessidade de proteger, melhorar e conservar o meio ambiente;<br \/>\n<strong>XII<\/strong> &#8211; articular-se com outros \u00d3rg\u00e3os e Secretarias da Prefeitura, em especial as de Administra\u00e7\u00e3o, Obras, Urbanismo, Sa\u00fade e Educa\u00e7\u00e3o, para a integra\u00e7\u00e3o de suas atividades;<br \/>\n<strong>XIII &#8211;<\/strong> manter interc\u00e2mbio com entidades nacionais e estrangeiras para o desenvolvimento de planos, programas e projetos ambientais;<br \/>\n<strong>XIV<\/strong> &#8211; promover, em conjunto com os demais \u00f3rg\u00e3os municipais, o controle da utiliza\u00e7\u00e3o, comercializa\u00e7\u00e3o, armazenagem e transporte de produtos t\u00f3xicos e\/ou perigosos;<br \/>\n<strong>XV &#8211;<\/strong> acionar o Conselho de Meio Ambiente e implementar as suas delibera\u00e7\u00f5es;<br \/>\n<strong>XVI &#8211;<\/strong> submeter \u00e0 delibera\u00e7\u00e3o do Conselho de Meio Ambiente as propostas de pol\u00edticas, normatiza\u00e7\u00f5es, procedimentos e diretrizes definidas para o gerenciamento ambiental municipal;<br \/>\n<strong>XVII<\/strong> &#8211; submeter \u00e0 delibera\u00e7\u00e3o do Conselho de Meio Ambiente os pareceres t\u00e9cnicos e jur\u00eddicos emitidos pela Secretaria, referentes ao licenciamento ambiental de atividades potencialmente degradadoras do meio ambiente, bem como as proposi\u00e7\u00f5es de aplica\u00e7\u00e3o de penalidades.<br \/>\n<strong>Art. 41<\/strong>. SECRETARIA MUNICIPAL DE CULTURA E TURISMO:<br \/>\nArt. 48.<\/strong> A Secretaria Municipal de Cultura, Turismo e Comunica\u00e7\u00e3o representada pela sigla \u201cSEMCTC\u201d, \u00e9 o \u00f3rg\u00e3o de execu\u00e7\u00e3o program\u00e1tica, subordinado diretamente ao Chefe do Poder Executivo, incumbido em planejar, superintender, elaborar, supervisionar e coordenar as a\u00e7\u00f5es e pol\u00edticas p\u00fablicas direcionadas \u00e0 \u00e1rea cultural e art\u00edstica, bem como ao incremento e desenvolvimento do setor tur\u00edstico do Munic\u00edpio.<br \/>\n<strong>Art. 49.<\/strong> A Secretaria Municipal de Cultura, \u00a0Turismo e Comunica\u00e7\u00e3o possui a seguinte \u00a0estrutura organizacional:<br \/>\n<strong>I \u2013<\/strong> Secretaria Municipal de Cultura e Turismo;<br \/>\n<strong>II \u2013<\/strong> Assessoria de Apoio T\u00e9cnico Administrativo;<br \/>\n<strong>III \u2013<\/strong> Coordena\u00e7\u00e3o de Cultura;<br \/>\n<strong>a)<\/strong> Departamento de Pesquisa e Avalia\u00e7\u00e3o;<br \/>\n<strong>b)<\/strong> Departamento de Cria\u00e7\u00e3o;<br \/>\n<strong>c)<\/strong> Departamento de Execu\u00e7\u00e3o;<br \/>\n<strong>IV &#8211;<\/strong> Coordena\u00e7\u00e3o de Turismo;<br \/>\n<strong>a &#8211;<\/strong> Departamento de desenvolvimento e Avalia\u00e7\u00e3o.<br \/>\n<strong>V \u2013<\/strong> Coordena\u00e7\u00e3o de Comunica\u00e7\u00e3o;<br \/>\n<strong>CAP\u00cdTULO XIV &#8211; SECRETARIA MUNICIPAL DE ESPORTE E JUVENTUDE:<\/strong><br \/>\n<strong>Art. 50.<\/strong> A Secretaria Municipal de Esporte e Juventude representada pela sigla \u201cSEMJUV\u201d, \u00e9 o \u00f3rg\u00e3o de execu\u00e7\u00e3o program\u00e1tica, subordinado diretamente ao Chefe do Poder Executivo, incumbido de planejar, coordenar, supervisionar, avaliar e controlar as a\u00e7\u00f5es do Governo Municipal, relacionadas as \u00e1reas dos Esportes e do Desenvolvimento Juvenil.<br \/>\n<strong>Art. 51.<\/strong> A Secretaria Municipal de Esporte e Juventude possui a seguinte estrutura organizacional:<br \/>\n<strong>I &#8211;<\/strong> Secretaria Municipal de Esporte e Juventude;<br \/>\n<strong>a)<\/strong>Assessor de Apoio T\u00e9cnico Administrativo;<br \/>\n<strong>II &#8211;<\/strong> Coordena\u00e7\u00e3o de Planejamento e Avalia\u00e7\u00e3o das A\u00e7\u00f5es Esportivas;<br \/>\n<strong>a)<\/strong> Departamento de desenvolvimento das Modalidades Esportivas;<br \/>\n<strong>b)<\/strong> Departamento de Execu\u00e7\u00e3o;<br \/>\n<strong>c)<\/strong> Departamento Administrativo dos Espa\u00e7os Esportivos;<br \/>\n<strong>d)<\/strong> Departamento de Log\u00edstica;<br \/>\n<strong>e)<\/strong> Departamento de Gest\u00e3o e Manuten\u00e7\u00e3o de Equipamentos Esportivos;<br \/>\n<strong>f)<\/strong> Departamento de Inclus\u00e3o Esportiva.<br \/>\n<strong>III \u2013<\/strong> Coordena\u00e7\u00e3o de Incentivo a Juventude;<br \/>\n<strong>T\u00cdTULO IV &#8211; DISPOSI\u00c7\u00d5ES GERAIS:<br \/>\n<\/strong><strong>Art. 52<\/strong>. Os \u00f3rg\u00e3os e cargos criados, extintos ou renomeados, referentes \u00e0 estrutura b\u00e1sica do Poder Executivo, ser\u00e3o regulamentados pelo chefe do Poder Executivo Municipal.<br \/>\n<strong>\u00a71\u00ba.<\/strong> Os servidores do quadro efetivo das Secretarias criadas, incorporadas ou desmembradas por esta Lei, com os seus respectivos cargos efetivos, ser\u00e3o redistribu\u00eddos de acordo com o interesse P\u00fablico, por ato do Poder Executivo.<br \/>\n<strong>\u00a72\u00ba.<\/strong> Os vencimentos pelo exerc\u00edcio dos cargos p\u00fablicos criados pela presente Lei ficam estabelecidos no Anexo II.<br \/>\n<strong>\u00a73\u00ba<\/strong>. A op\u00e7\u00e3o pelo cargo em comiss\u00e3o implica em imediato afastamento do servidor do seu cargo original, ressalvados os casos de acumula\u00e7\u00e3o legal comprovada.<br \/>\n<strong>\u00a74\u00ba.<\/strong> Durante o per\u00edodo em que o servidor p\u00fablico efetivo, que se encontre em est\u00e1gio probat\u00f3rio ocupar cargo de provimento em comiss\u00e3o, interromper-se-\u00e1 o referido est\u00e1gio.<br \/>\n<strong>Art. 53.<\/strong> Nenhum \u00f3rg\u00e3o poder\u00e1 realizar despesas se n\u00e3o dispuser de recursos or\u00e7ament\u00e1rio espec\u00edficos para o fim almejado e n\u00e3o houver disponibilidade de recursos financeiros para sua liquida\u00e7\u00e3o, certificados pelos \u00f3rg\u00e3os competentes.<br \/>\n<strong>Art. 54.<\/strong> Para atender as necessidades de servi\u00e7os ou para execu\u00e7\u00e3o de programas espec\u00edficos ou especiais, para cujo desenvolvimento n\u00e3o se justifique a cria\u00e7\u00e3o de Secretaria, fica o Chefe do Poder Executivo Municipal autorizado a criar, atrav\u00e9s de decreto, at\u00e9 cinco departamentos extraordin\u00e1rios, e seus respectivos cargos, atribuindo-lhes igualmente as compet\u00eancias.<br \/>\n<strong>Art. 55<\/strong>. O Prefeito Municipal, enviar\u00e1 Projeto de Lei, em at\u00e9 90 (noventa) dias, a contar da publica\u00e7\u00e3o desta Lei, definir\u00e1 o Regimento Interno e as atribui\u00e7\u00f5es espec\u00edficas \u00a0de cada unidade administrativa e o sistema de seu desempenho, podendo delegar compet\u00eancias \u00e0s diversas chefias para proferir despachos decis\u00f3rios, podendo a qualquer momento avocar a compet\u00eancia delegada.<br \/>\n<strong>Par\u00e1grafo \u00fanico.<\/strong> As altera\u00e7\u00f5es decorrentes desta Lei, ser\u00e3o implantadas gradativamente e passar\u00e3o a vigorar conforme venha dispor as Leis posteriores, Decretos, Regimentos e Regulamentos.<br \/>\n<strong>Art. 56<\/strong>. Os ocupantes dos Cargos de Provimento Comissionado, institu\u00eddos pela presente Lei, com exce\u00e7\u00e3o dos Secret\u00e1rios Municipais, a crit\u00e9rio da Administra\u00e7\u00e3o, receber\u00e3o gratifica\u00e7\u00e3o de at\u00e9 100% (cem por cento) de seus vencimentos.<br \/>\n<strong>Art. 57.<\/strong> Os servidores titulares de cargo efetivo que venham a ser nomeados para ocupar cargo em comiss\u00e3o, receber\u00e3o os vencimentos do seu cargo efetivo, podendo ser atribu\u00edda uma gratifica\u00e7\u00e3o de representa\u00e7\u00e3o no percentual de at\u00e9 50% (cinquenta por cento) do valor do vencimento em comiss\u00e3o correspondente.<br \/>\n<strong>Art. 58. \u2013<\/strong> Fica o Chefe do Poder Executivo autorizado a remanejar, transpor, transferir ou utilizar as dota\u00e7\u00f5es or\u00e7ament\u00e1rias, aprovadas na Lei Or\u00e7ament\u00e1ria para o exerc\u00edcio de 2021, em favor dos \u00f3rg\u00e3os criados por esta Lei, de modo a assegurar a continuidade das a\u00e7\u00f5es governamentais.<br \/>\n<strong>Art. 59.<\/strong> Esta Lei entra em vigor na data de sua publica\u00e7\u00e3o, revogando-se as disposi\u00e7\u00f5es em contr\u00e1rios, especialmente as Leis Municipais n\u00bas 429\/2012, de 14 de dezembro de 2012 e 491\/2017, de 02 de outubro de 2017.<br \/>\nPal\u00e1cio Benedito Lima e Silva, Gabinete do Prefeito Municipal de Magalh\u00e3es de Almeida\/MA, em 27 de dezembro de 2021.
